ILEHA Special Board Meeting Minutes

February 20, 2024 

The Board met in special session by call-in on February 20, 2024, to discuss the advice and recommendations of legal counsel Doug Austin regarding an ILE homeowner fence issue.   In attendance were Katie McPherson, Sean Looman, Dan Dapkus, Ned Walker, Joe Pavona, and Cindy Carson.  The meeting was called to order at 6:35 pm by Joe Pavona.

Mr. Austin’s draft recommendations were discussed with each Board member contributing to the discussion.  The discussion included comments that over the past few years no fewer than six homeowners’ requests for fences have been denied as well as one homeowner having to remove a fence.  Additionally, two homeowners have had fence requests approved to enclose outdoor inground swimming pools.

After much discussion and consideration, it was agreed to have Mr. Austin submit his final recommendations for Board approval.  Once approved, the Board will then include Mr. Austin’s recommendations with our response to the homeowner’s communication to the Board dated October 16, 2023.

Following the receipt of Mr. Austin’s final recommendations, it will be shared with all Board members.  Following individual review, the Board agreed to then vote by email to accept or not accept the recommendations, and if accepted, to include them in our response to the homeowner.

Mr. Austin’s final recommendations were received on February 23, 2024, and distributed to Board members.  On February 24, 2024, Sean Looman made a motion to accept Mr. Austin’s recommendation and respond to the homeowner’s correspondence of October 16, 2023, accordingly with a Board cover memorandum that includes Mr. Austin’s recommendations.  The motion was seconded by Dan Dapkus.  There was no further discussion.  The motion was unanimously approved with Cindy Carson recusing herself from the vote.

Joe Pavona asked that the next regularly scheduled Board meeting of February 27, 2024, be rescheduled as he has a scheduling conflict.  The Board agreed to meet on March 13, 2024, at 7 pm.
